Terms of Service

1. Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.
2. Accuracy Of Information
Occasionally, there may be information on the website that contains typographical errors, inaccuracies, or omissions related to promotions and offers. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the website or on any related Service is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend, or clarify information on the website including, without limitation, pricing information, except as required by law. No specified update or refresh date applied on the website should be taken to indicate that all information on the website or on any related Service has been modified or updated.
3. Accounts And Membership
- If you create an account on the website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it.
- To order any of our services, the account holder must be 18 years of age or older. If under 18 but 13 years of age or older, you may order services as long as you have direct permission from a parent or legal guardian.
- You agree not to bypass any security features we have installed to uphold this Agreement.
- LoafHosts LLC does not assume any responsibility for misrepresentations regarding a user's age. We assume all account holders are above the required age or have parental/guardian permission.
LoafHosts LLC reserves the right to refuse service to anyone. Services must be used for lawful purposes in accordance with United States federal and Pennsylvania state law. We do not permit any illegal use of our services. We reserve the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.
Providing false contact information may result in account termination. You must notify us immediately of any unauthorized use of your account or breaches of security. We are not liable for damages incurred due to such acts or omissions. We may suspend, disable, or delete your account if we determine a violation of this Agreement.
4. Billing And Payments
- You shall pay all fees or charges to your account in accordance with the terms in effect at the time the fee or charge is due.
- Invoices with no verified payment within 24 hours of the due date will be suspended. Invoices with no verified payment within 3 days of the due date will be terminated.
- If auto-renewal is enabled, charges will be applied automatically.
- You are responsible for all fees owed from account establishment to termination, which does not forgive debts owed to LoafHosts LLC.
- LoafHosts LLC may offer promotional rates or exclusive offers with specific terms.
- Chargebacks or disputes will result in instant server suspension and the revocation of any right to a refund.
5. Refunds
LoafHosts LLC offers a 24-hour guarantee refund policy. Services are eligible for refund if requested within 24 hours of order placement, provided payment is received. Refunds are not provided for domains, dedicated servers, colocation, and add-ons unless approved by LoafHosts LLC.
Services are eligible for a full refund if the following prerequisites are met:
- Refund requested within 24 hours of product creation
- Request made with legitimate reasoning
- Product or service is not paid using a promotional discount greater than 25% off the original price
- Product or service is not an upgrade
Refund requests are void if the Terms of Service or Acceptable Usage Policy is violated.
6. Acceptable Use
Clients are responsible for complying with the policies of LoafHosts LLC. Failure to do so may result in suspension or termination. Prohibited actions include, but are not limited to:
- Denial of Service (DoS) attacks
- Distributed Denial of Service (DDoS) attacks
- Malware and/or ransomware
- Cyberbullying, harassment, or encouraging self-harm
- Child/adult pornography
- Software piracy
- Identity theft
- Spam servers
- IP spoofing
- Phishing
- Bypassing usage limits (bandwidth, CPU, RAM, etc.)
7. Service Setup
LoafHosts LLC strives to set up all services immediately after payment is received. However, some factors may delay setup, such as client password issues or payment verification.
8. Uptime Guarantee
Refer to the LoafHosts LLC Service Level Agreement for all downtime policies.
9. Support Obligation
LoafHosts LLC provides unmanaged support unless otherwise stated. We reserve the right to offer semi-managed and/or managed support to selective clients. We will assist with technical errors caused by our services but will not perform daily tasks such as server installations or software setups.
10. Domains
Clients must abide by the domain registration agreement and proxy agreement when applicable. Domain clients are responsible for upkeeping payments and handling grace and redemption periods.
11. Licensing
Clients must provide legitimate/legal licenses for services installed on LoafHosts LLC's network. LoafHosts LLC does not provide Windows licenses, and clients are responsible for acquiring any necessary licenses.
12. Backups
LoafHosts LLC is not responsible for the loss of any content. Clients are responsible for maintaining appropriate backups. In some circumstances, LoafHosts LLC may restore data, but this is not guaranteed.
13. Bandwidth/Storage Policy
While we offer unlimited bandwidth and storage, we reserve the right to remove excessive files that may impact the node or limit bandwidth traffic. If unusual spikes in network activity occur, we may impose soft limits or charge $2.00 per terabyte (TB) for usage beyond the monthly limit.
14. IP Address Assignment
LoafHosts LLC maintains ownership and control over all IPv4/IPv6 addresses. We reserve the right to change, remove, or banish any IP addresses at our discretion.
15. Cancellation
Clients wishing to cancel a service must submit a request via our client area. Once processed, services will be deleted and are not recoverable.
16. Termination
LoafHosts LLC reserves the right to terminate services for any violation of the terms or any other reason deemed necessary. Services suspended for non-payment will be terminated 3 days after the first invoice due date.
17. Third-Party Services
If you use third-party services, your access and use of these services are governed by the terms of those services. LoafHosts LLC is not responsible for third-party services or their content and does not endorse them.
18. Links To Other Websites
LoafHosts LLC may provide links to other websites, but does not imply any endorsement. Some links may be affiliate links, earning LoafHosts LLC commissions.
19. Intellectual Property Rights
This Agreement does not transfer any intellectual property owned by LoafHosts LLC or third parties. All trademarks and service marks remain the property of LoafHosts LLC or their respective owners.
20. Limitation Of Liability
LoafHosts LLC will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits or business interruption. Our liability is limited to the amount paid by the client for services in the prior month.
21. Indemnification
You agree to indemnify LoafHosts LLC from any liabilities, damages, or costs, including attorneys' fees, arising from third-party claims related to your use of the services.
22. Dispute Resolution
The formation, interpretation, and performance of this Agreement will be governed by the laws of Pennsylvania. Any disputes will be resolved in Pennsylvania courts, and you waive any right to a jury trial.
23. Assignment
You may not assign or transfer any rights or obligations under this Agreement without prior written consent from LoafHosts LLC. We may assign our rights at any time.
24. Changes And Amendments
LoafHosts LLC reserves the right to modify this Agreement or related policies at any time. Changes will be posted on the website, and continued use of the services constitutes acceptance of these changes.
25. Acceptance Of These Terms
By using the website or its services, you acknowledge that you have read and agree to the terms of this Agreement. If you do not agree to these terms, you are not authorized to use the services.
